The first predisposition for this, is that you were married. The next thing that you must achieve, is to have been separated for a period of at least twelve (12) months.

Divorce is an important consideration, because, if you separate from your husband or wife and do not get divorced, you may have entitlements relating to your marriage that continue right until after your death.

Getting divorced is not the same as finalizing your financial or parenting matters. If these things apply to you, we would recommend you read our information relating to these too.

We recommend that you do not obtain a divorce until after you have finalized your financial matter as when you get a divorce, you then only have twelve (12) months to finalize your property matter. You can read more about this under our heading relating to financial matters.

To get a divorce, you must have been separated for a period of at least twelve (12) months. You can be considered separated whilst still living under the same roof, however, you have to provide the Court more evidence if this applies.

You can either apply for a divorce on your own, or can do a joint application with your former husband/wife.

If you have been married for less than two years then other factors will also apply.
